Terms of Service

2. Eligibility

You may use heyghe only if all of the following are true:

• You are at least 18 years old.
• You received an explicit invite from heyghe to the email address you sign in with.
• The Instagram account you connect is yours, OR you have the explicit written authorization of the account owner to operate it on their behalf.
• The Instagram account is a Business or Creator account (Meta's webhook APIs do not deliver events for Personal accounts).
• You agree to comply with Meta's Platform Terms, Meta Developer Policies, and Instagram Community Guidelines.

3. Account responsibilities

• Don't share invite tokens, magic-link emails, or session cookies with anyone.
• Keep your authenticator-app device secure. TOTP-based 2FA is required for owner accounts and strongly recommended for everyone else.
• Disconnect any Instagram accounts you no longer manage. Tokens for disconnected accounts are deleted immediately on our side.
• You are responsible for the messages your automations send. heyghe doesn't review DM content before it goes out; if your audience complains, that's on you to address.

4. Acceptable use

You agree NOT to use heyghe to:

• Send unsolicited messages (cold outreach, bulk DMs). heyghe is built on the explicit premise that every DM is a reply to a viewer who typed your keyword. Cold-DM patterns will get your IG account suspended by Meta long before we catch them.
• Run political mass-messaging, election campaigns, or coordinated inauthentic behavior.
• Distribute adult / sexually explicit content, malware, phishing links, financial scams, MLM funnels, or content that exploits vulnerable audiences.
• Impersonate any person, brand, or entity, or misrepresent your affiliation with them.
• Send content that is illegal, harassing, discriminatory, defamatory, or that infringes anyone's intellectual property.
• Circumvent Meta's rate limits, the 24-hour messaging window, or any other Instagram Platform restriction.
• Use heyghe to manage Instagram accounts you don't own or have explicit written authorization to manage.

We reserve the right to suspend or terminate your access immediately if we detect violations of the above, of Meta's Platform Terms, or of applicable Indian law. We do not need to give prior notice for safety-critical violations.

5. Instagram and Meta: what heyghe is, and isn't

• heyghe is a third-party tool that uses Meta's official Instagram Graph API. We do not scrape Instagram, automate the web UI, or use unauthorized endpoints.
• heyghe is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram.
• Meta can change, restrict, or revoke API access independently of heyghe. We will tell you as soon as we know, but we can't promise the API will keep behaving the way it does today.
• You are responsible for your own compliance with Instagram's Community Guidelines and Meta's Platform Terms. We expect creators to follow these. We don't, and won't, override them on your behalf.
• Meta retains the right to throttle or reject any send. If they do, heyghe will surface the error in your dashboard but we cannot force the delivery.

6. Your content and data

• You retain ownership of every automation, DM template, image, and form submission you create with heyghe.
• You grant heyghe the limited, revocable right to store, process, and transmit this content as needed to operate the service on your behalf.
• We do not claim ownership of any Instagram comment, viewer profile, or other third-party data that flows through heyghe via Meta's webhooks.
• You can export or delete your data at any time. See our Privacy Policy §7.

7. Service availability and beta status

heyghe is offered "as is" during the private beta. We commit to fixing issues responsibly and communicating outages, but during the beta:

• There is no service-level agreement (SLA) for uptime or DM-delivery latency.
• We may add, change, or remove features without notice. We won't break paid promises, since there aren't any yet.
• Outages happen. heyghe runs on Cloudflare; we share their reliability profile. We'll communicate via email for outages longer than 30 minutes.
• Some Meta API endpoints have undocumented behavior; we may not catch every edge case on day one.

8. Pricing

heyghe is free during the private beta. We will give every active beta user at least 30 days' written notice before charging anyone. If we introduce paid plans, pricing will be flat or DM-count-based, never per-contact (the model we're explicitly built to undercut). No beta user will be charged retroactively.

9. Termination

• You can stop using heyghe at any time. Visit app.heyghe.com → Settings → Danger Zone to delete your account, or email hello@heyghe.com.
• We can terminate your access for violations of these Terms, for legal reasons, or because the beta has ended. Except for safety-critical violations, we'll give you at least 7 days' notice.
• Upon termination, your data is deleted per the retention schedule in our Privacy Policy §2 and §7.

10. Limitation of liability

To the maximum extent permitted by Indian law, heyghe (Pranav Bhatkar, the individual operator) will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost revenue, lost followers, lost goodwill, or business interruption) arising from your use of heyghe, even if we were advised of the possibility.

Our total liability for any direct damages will not exceed ₹0 during the beta (since you are not paying for the service). If paid plans launch in the future, our liability will not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing law

These Terms are governed by the laws of the Republic of India. Any dispute will be resolved exclusively in the courts of Amravati, Maharashtra, India.

12. Changes to these terms

We will update the "Last updated" date at the top of this page whenever these Terms change. Material changes will be emailed to every active beta user at least 30 days before they take effect. Continued use of heyghe after the notice period counts as acceptance.
